Declaring the Expropriation of a Plot of Land as a Work of Public Benefit

The Prime Minister

Having reviewed:

  • The Constitution;

  • Law No. 43 of 1979 on the Local Administration System and its Executive Regulations;

  • Law No. 10 of 1990 on the Expropriation of Real Estate for Public Benefit and its Executive Regulations;

  • Presidential Decree No. 279 of 2018 delegating certain powers;

  • Prime Minister’s Decision No. 2513 of 2023;

  • The submission by the Minister of Transport;

Decides

Article One
The project to expropriate a plot of land, with an area of 250 feddans, located south of the Alexandria–Matrouh railway line in the King Mariout area of Alexandria Governorate, necessary for establishing a station and route for the first line of the high-speed electric train network, and for urban planning and improving public utilities, shall be considered a work of public benefit. This is in favor of the National Authority for Tunnels (Ministry of Transport).

Article Two
The aforementioned land referred to in the previous article — with its location, area, boundaries, and apparent owners specified in the explanatory memorandum, cadastral maps, description card, and annexed ownership list — shall be seized by direct execution.

Article Three
Prime Minister’s Decision No. 2513 of 2023 referred to above is hereby repealed.

Article Four
This decision shall be published in the Official Gazette and shall come into force the day following its publication.

Ministry of Transport – Explanatory Memorandum

The Prime Minister’s Decision No. 2513 of 2023 declared the project to expropriate a plot of land measuring 250 feddans south of the Alexandria–Matrouh railway line in King Mariout, Alexandria Governorate, as a work of public benefit, for urban planning, improving public utilities, and establishing a high-speed electric train station.

On 29 April 2024, the Office of the President (Letter No. 8153) communicated the directives of the President from a meeting held on 22 April 2024 — attended by the Prime Minister and the Ministers of Planning, Finance, and Transport — instructing the Ministry of Transport to take steps to cancel the referenced decision and issue a new decision to expropriate the entire 250 feddans, including the Al-Babtain land and all other existing holdings, in favor of the Ministry of Transport. A portion of this land is to be allocated for the route of the first line of the high-speed electric train, with the remainder to be replanned by the Ministry of Transport (Annex 1).

Due to the special nature of the project, which requires multiple work sites, it is not possible at present to enumerate all landowners and properties affected by the project. Therefore, it is proposed to include a clause in the decision allowing direct execution.

It is noted that EGP 50 million will be allocated from the National Authority for Tunnels’ budget for FY 2023/2024 to cover the preliminary estimated compensations for apparent owners, to be deposited into the account of the executing authority within three months of the decision’s issuance, as determined by the relevant committee.

Attachments:

  1. Two cadastral maps showing the overall project route (Annex 2).

  2. List of apparent owners and description card of the land to be expropriated (Annex 3).

To expedite implementation and land clearance over the required site, and to designate it as public benefit land urgently from the date of the decision’s publication, it is proposed to include a provision allowing for direct execution of expropriation.

In light of the above, the attached draft decision includes the following:

  • Repeal of Prime Minister’s Decision No. 2513 of 2023.

  • Declaration of the expropriation project for the 250 feddans south of the Alexandria–Matrouh railway line in King Mariout, Alexandria Governorate, as a work of public benefit, in favor of the National Authority for Tunnels, for establishing a station and route for the first line of the high-speed electric train network, with direct execution.
