Cette \u00e9tude traite de l\u2019une des questions immobili\u00e8res les plus complexes du pays, r\u00e9sultant d\u2019accumulations et d\u2019enchev\u00eatrements juridiques historiques ayant compliqu\u00e9 la relation entre propri\u00e9taires et locataires.<\/p>\n<p data-start=\"1134\" data-end=\"1817\">La publication propose une analyse approfondie du r\u00e9gime des anciens loyers en \u00c9gypte et examine les d\u00e9fis l\u00e9gislatifs et urbains qui lui sont associ\u00e9s \u00e0 travers l\u2019\u00e9tude des probl\u00e9matiques juridiques, \u00e9conomiques et urbaines d\u00e9coulant de sa persistance. Elle analyse \u00e9galement son impact direct sur la relation bailleur\u2013locataire et sur le march\u00e9 immobilier en g\u00e9n\u00e9ral. En revanche, ce syst\u00e8me constitue une charge \u00e9conomique pour de nombreux propri\u00e9taires, qui peinent \u00e0 obtenir un rendement \u00e9quitable de leurs biens en raison du gel des valeurs locatives depuis plusieurs d\u00e9cennies.<\/p>\n<p data-start=\"2287\" data-end=\"2784\">Malgr\u00e9 son importance, le dossier des anciens loyers est rest\u00e9 pendant des ann\u00e9es devant les juridictions sans intervention l\u00e9gislative claire visant \u00e0 corriger le d\u00e9s\u00e9quilibre entre les parties \u00e0 la relation locative. Cette situation a accentu\u00e9 l\u2019\u00e9cart entre les loyers anciens et les prix actuels du march\u00e9, ouvrant la voie \u00e0 un tiers \u2014 repr\u00e9sent\u00e9 par les investisseurs immobiliers \u2014 cherchant \u00e0 prendre le contr\u00f4le de ces unit\u00e9s, notamment celles situ\u00e9es dans des zones \u00e0 forte valeur fonci\u00e8re.<\/p>\n<p data-start=\"2786\" data-end=\"3552\">Dans ce contexte, la note souligne l\u2019orientation donn\u00e9e par l\u2019autorit\u00e9 politique tant au pouvoir judiciaire qu\u2019au pouvoir l\u00e9gislatif. Bien que l\u2019affaire dans laquelle la Haute Cour constitutionnelle a d\u00e9clar\u00e9 inconstitutionnels deux articles des lois sur les anciens loyers soit rest\u00e9e pendante devant les tribunaux pendant plus de vingt-six ans, le jugement n\u2019a \u00e9t\u00e9 rendu qu\u2019\u00e0 la suite de d\u00e9clarations directes du Pr\u00e9sident de la R\u00e9publique appelant \u00e0 r\u00e9gler ce dossier, suivies d\u2019une mobilisation notable du Parlement \u00e9gyptien. Diwan Al-Omran exprime son inqui\u00e9tude quant au d\u00e9lai restreint accord\u00e9 au Parlement pour traiter cette question, ce qui pourrait emp\u00eacher l\u2019\u00e9laboration d\u2019une l\u00e9gislation \u00e9quilibr\u00e9e prenant en consid\u00e9ration les int\u00e9r\u00eats des deux parties.<\/p>\n<p data-start=\"3554\" data-end=\"4140\">La note met \u00e9galement en \u00e9vidence le r\u00f4le croissant des soci\u00e9t\u00e9s d\u2019investissement immobilier et de l\u2019Autorit\u00e9 des nouvelles communaut\u00e9s urbaines dans l\u2019acquisition de vastes \u00e9tendues de terrains et de biens immobiliers \u00e0 des fins de revente et de profit. Diwan Al-Omran met en garde contre le risque que les biens soumis au r\u00e9gime des anciens loyers deviennent la prochaine cible de ces entit\u00e9s si la lib\u00e9ralisation de la relation bailleur\u2013locataire intervient sans garanties claires prot\u00e9geant le droit \u00e0 un logement ad\u00e9quat et assurant un \u00e9quilibre contractuel entre les deux parties.<\/p>\n<p data-start=\"4142\" data-end=\"5103\">En conclusion, la note formule plusieurs recommandations aux niveaux du logement, de la l\u00e9gislation et de la relation bailleur\u2013locataire. Elle appelle \u00e0 une r\u00e9orientation des politiques du logement en \u00c9gypte afin de garantir la justice urbaine et la stabilit\u00e9 r\u00e9sidentielle des classes moyennes et modestes, \u00e0 travers une r\u00e9gulation efficace du march\u00e9 immobilier, l\u2019adoption de politiques fiscales limitant la sp\u00e9culation et l\u2019orientation des investissements vers des projets de logement social et abordable. Elle pr\u00e9conise \u00e9galement que l\u2019\u00c9tat retrouve son r\u00f4le dans la production de logements, en s\u2019\u00e9loignant d\u2019une approche strictement ax\u00e9e sur le profit, et qu\u2019il encadre les relations entre l\u2019\u00c9tat et le secteur priv\u00e9 par des politiques obligeant les promoteurs \u00e0 r\u00e9server un pourcentage de leurs projets aux groupes d\u00e9favoris\u00e9s. Cela inclut l\u2019octroi d\u2019un soutien direct aux familles sous forme de pr\u00eats subventionn\u00e9s et de programmes de location-accession.<\/p>\n<p data-start=\"5105\" data-end=\"5644\">Au niveau l\u00e9gislatif, Diwan Al-Omran insiste sur la n\u00e9cessit\u00e9 de r\u00e9viser les lois relatives au d\u00e9veloppement urbain afin d\u2019assurer leur conformit\u00e9 avec les principes de justice sociale, de d\u00e9finir juridiquement l\u2019expulsion forc\u00e9e conform\u00e9ment aux normes internationales et de garantir des alternatives et des compensations \u00e9quitables. La note appelle \u00e9galement au renforcement des m\u00e9canismes de contr\u00f4le juridique et \u00e0 la participation des communaut\u00e9s concern\u00e9es dans l\u2019\u00e9laboration des politiques et des l\u00e9gislations relatives au logement.<\/p>\n<p data-start=\"5646\" data-end=\"7055\" data-is-last-node=\"\" data-is-only-node=\"\">S\u2019agissant de la relation bailleur\u2013locataire, Diwan Al-Omran propose l\u2019adoption d\u2019un m\u00e9canisme d\u2019augmentation progressive des loyers refl\u00e9tant les taux d\u2019inflation ou les revenus r\u00e9els des locataires, la fin de la transmissibilit\u00e9 h\u00e9r\u00e9ditaire des contrats de location \u2014 sauf pour le conjoint et pour une p\u00e9riode transitoire limit\u00e9e \u2014 ainsi que l\u2019\u00e9tablissement d\u2019un inventaire des unit\u00e9s vacantes relevant du r\u00e9gime des anciens loyers et leur remise progressive sur le march\u00e9 selon des m\u00e9canismes \u00e9quitables. La note recommande en outre l\u2019imposition de limites strictes \u00e0 l\u2019expulsion ou \u00e0 la r\u00e9siliation des contrats pour les logements occup\u00e9s sans la fourniture d\u2019une alternative adapt\u00e9e. Elle souligne la responsabilit\u00e9 de l\u2019\u00c9tat de soutenir les parties affect\u00e9es des deux c\u00f4t\u00e9s par la cr\u00e9ation d\u2019un fonds de soutien \u00e0 la valeur locative et par l\u2019octroi d\u2019exon\u00e9rations fiscales aux propri\u00e9taires, financ\u00e9s par l\u2019\u00c9tat et par les recettes issues de la r\u00e9gularisation des infractions de construction.
