Nous avons \u00e9galement \u00e9voqu\u00e9 le r\u00f4le de ce syst\u00e8me dans la stabilit\u00e9 r\u00e9sidentielle de nombreux groupes sociaux malgr\u00e9 l\u2019inertie l\u00e9gislative.<\/p>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"951\" data-end=\"1491\">Le <a href=\"https:\/\/diwanalomran.com\/fr\/le-systeme-des-anciens-loyers-en-egypte-un-historique-dinterventions-legislatives-et-de-transformations-sociales\/\">deuxi\u00e8me article<\/a>, <strong data-start=\"972\" data-end=\"1093\">\u00ab Le syst\u00e8me des anciens loyers en \u00c9gypte : histoire des interventions l\u00e9gislatives et des transformations sociales \u00bb<\/strong>, a permis de revenir sur le contexte historique et l\u00e9gislatif du syst\u00e8me, en partant des lois d\u2019exception sur les loyers au milieu du XXe si\u00e8cle, et sur la mani\u00e8re dont ces lois ont red\u00e9fini les relations entre l\u2019\u00c9tat et les citoyens en mati\u00e8re de logement. Nous avons examin\u00e9 l\u2019\u00e9volution de la perception du droit de propri\u00e9t\u00e9 face au droit au logement et ses implications sociales et politiques.<\/p>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"1493\" data-end=\"2147\">Le <a href=\"https:\/\/diwanalomran.com\/fr\/analyse-du-systeme-de-location-ancien-et-de-son-impact-sur-les-proprietaires-et-les-locataires\/\">troisi\u00e8me article<\/a>, <strong data-start=\"1515\" data-end=\"1617\">\u00ab Analyse du syst\u00e8me des anciens loyers et de son impact sur les propri\u00e9taires et les locataires \u00bb<\/strong>, a propos\u00e9 une lecture analytique approfondie de la relation complexe entre les deux parties. Nous avons expos\u00e9 les pr\u00e9judices subis par les propri\u00e9taires du fait des loyers fig\u00e9s et des restrictions sur la disposition des biens, tout en montrant comment le syst\u00e8me avait permis \u00e0 une large frange de la population \u00e0 faibles revenus de r\u00e9sider dans des zones centrales. Nous avons \u00e9galement \u00e9voqu\u00e9 l\u2019intervention de tiers, tels que les investisseurs et les instances \u00e9tatiques, et son impact sur l\u2019avenir des relations locatives.<\/p>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"2149\" data-end=\"3553\">Enfin, ce quatri\u00e8me article vise \u00e0 proposer des solutions justes et \u00e9quilibr\u00e9es prenant en compte les int\u00e9r\u00eats des propri\u00e9taires comme des locataires, tout en tenant compte du contexte \u00e9conomique, social et d\u00e9mographique \u00e9gyptien. L\u2019objectif est de parvenir \u00e0 une justice \u00e9quilibr\u00e9e, d\u2019\u00e9viter toute forme de discrimination, et de se conformer aux normes internationales des droits humains, notamment le droit \u00e0 un logement convenable. Sur la base de l\u2019analyse du syst\u00e8me des anciens loyers et de son interaction avec plusieurs droits humains fondamentaux, notamment le droit au logement et la protection contre les expulsions forc\u00e9es, ce document pr\u00e9sente un ensemble de recommandations au gouvernement et au Parlement \u00e9gyptiens, en tant qu\u2019autorit\u00e9s l\u00e9gislatives responsables de promulguer les lois permettant de r\u00e9soudre cette question. Bien que l\u2019initiative gouvernementale pour traiter ce dossier soit venue tardivement, entra\u00eenant des complications entre les parties contractantes, la volont\u00e9 de r\u00e9soudre le probl\u00e8me repr\u00e9sente une opportunit\u00e9 majeure. Cette opportunit\u00e9 doit permettre l\u2019\u00e9laboration d\u2019une l\u00e9gislation \u00e9quitable qui garantisse les droits des deux parties et r\u00e9alise un \u00e9quilibre entre le droit de propri\u00e9t\u00e9 et la stabilit\u00e9 r\u00e9sidentielle, \u00e0 condition de prendre en compte toutes les dimensions \u00e9conomiques, sociales et culturelles pour assurer la justice dans les solutions propos\u00e9es.<\/p>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"3555\" data-end=\"4291\">Dans ce cadre, une forte volont\u00e9 existe chez de nombreux acteurs concern\u00e9s \u2013 propri\u00e9taires ou locataires \u2013 pour parvenir \u00e0 une formule contractuelle qui r\u00e9ponde aux besoins des deux parties. La soci\u00e9t\u00e9 civile joue \u00e9galement un r\u00f4le important en formulant des recommandations et des alternatives contribuant \u00e0 l\u2019\u00e9laboration de politiques de logement adapt\u00e9es aux diff\u00e9rentes cat\u00e9gories sociales. Ces solutions doivent garantir la justice sociale dans la r\u00e9partition des ressources r\u00e9sidentielles et participer \u00e0 l\u2019am\u00e9lioration du march\u00e9 immobilier, notamment face aux d\u00e9fis \u00e9conomiques rencontr\u00e9s par de nombreuses familles \u00e9gyptiennes et aux pratiques sp\u00e9culatives de certains acteurs lors des crises (notamment les crises migratoires).<\/p>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"4298\" data-end=\"4349\"><strong data-start=\"4298\" data-end=\"4349\">Premi\u00e8rement : Au niveau du secteur du logement<\/strong><\/p>\n<ul dir=\"ltr\" style=\"text-align: left;\" data-start=\"4351\" data-end=\"5484\">\n<li class=\"\" data-start=\"4351\" data-end=\"4691\">\n<p class=\"\" data-start=\"4353\" data-end=\"4691\">Mettre en place un contr\u00f4le effectif du march\u00e9 immobilier \u00e0 travers des politiques fiscales dissuasives contre la sp\u00e9culation fonci\u00e8re, orienter les investissements vers des projets de logement social et abordable, et encadrer les relations locatives pour assurer un \u00e9quilibre des loyers sans les laisser soumis aux seules lois du march\u00e9.<\/p>\n<\/li>\n<li class=\"\" data-start=\"4693\" data-end=\"4982\">\n<p class=\"\" data-start=\"4695\" data-end=\"4982\">Revenir \u00e0 une production \u00e9tatique de logements sociaux et destin\u00e9s aux classes moyennes, rompant avec les politiques actuelles qui visent principalement le profit, afin d\u2019assurer un r\u00f4le actif de l\u2019\u00c9tat dans la r\u00e9ponse aux besoins en logement des populations \u00e0 faibles et moyens revenus.<\/p>\n<\/li>\n<li class=\"\" data-start=\"4984\" data-end=\"5278\">\n<p class=\"\" data-start=\"4986\" data-end=\"5278\">Encadrer les partenariats entre l\u2019\u00c9tat et le secteur priv\u00e9 dans le domaine du logement par des politiques obligeant les promoteurs priv\u00e9s \u00e0 r\u00e9server un pourcentage de leurs projets \u00e0 des unit\u00e9s accessibles financi\u00e8rement, contribuant ainsi \u00e0 une r\u00e9partition \u00e9quitable des ressources urbaines.<\/p>\n<\/li>\n<li class=\"\" data-start=\"5280\" data-end=\"5484\">\n<p class=\"\" data-start=\"5282\" data-end=\"5484\">Offrir des m\u00e9canismes de soutien direct aux familles \u00e0 faibles revenus, comme les pr\u00eats \u00e0 taux r\u00e9duits ou les programmes de location-vente, afin de faciliter l\u2019acc\u00e8s \u00e0 un logement convenable et durable.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"5491\" data-end=\"5530\"><strong data-start=\"5491\" data-end=\"5530\">Deuxi\u00e8mement : Au niveau l\u00e9gislatif<\/strong><\/p>\n<ul dir=\"ltr\" style=\"text-align: left;\" data-start=\"5532\" data-end=\"6534\">\n<li class=\"\" data-start=\"5532\" data-end=\"5762\">\n<p class=\"\" data-start=\"5534\" data-end=\"5762\">Revoir les l\u00e9gislations relatives \u00e0 l\u2019urbanisme pour garantir leur compatibilit\u00e9 avec les principes de justice sociale et le droit au logement, et emp\u00eacher qu\u2019elles soient utilis\u00e9es comme outils de discrimination ou d\u2019exclusion.<\/p>\n<\/li>\n<li class=\"\" data-start=\"5764\" data-end=\"6030\">\n<p class=\"\" data-start=\"5766\" data-end=\"6030\">D\u00e9finir juridiquement et de mani\u00e8re pr\u00e9cise les expulsions forc\u00e9es en conformit\u00e9 avec les normes internationales, en identifiant les situations o\u00f9 elles sont strictement interdites, et en garantissant des alternatives de relogement et des compensations \u00e9quitables.<\/p>\n<\/li>\n<li class=\"\" data-start=\"6032\" data-end=\"6263\">\n<p class=\"\" data-start=\"6034\" data-end=\"6263\">Mettre en place des m\u00e9canismes de contr\u00f4le et des garanties juridiques pour prot\u00e9ger les habitants contre les expulsions sans consentement libre et pr\u00e9alable, en renfor\u00e7ant le r\u00f4le des instances de r\u00e9gulation et des juridictions.<\/p>\n<\/li>\n<li class=\"\" data-start=\"6265\" data-end=\"6534\">\n<p class=\"\" data-start=\"6267\" data-end=\"6534\">Associer les parties prenantes, notamment les communaut\u00e9s concern\u00e9es, \u00e0 l\u2019\u00e9laboration des lois relatives au logement et au d\u00e9veloppement urbain, afin de garantir que ces lois r\u00e9pondent aux besoins r\u00e9els des habitants et assurent leur application \u00e9quitable et durable.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" dir=\"ltr\" style=\"text-align: left;\" data-start=\"6541\" data-end=\"6608\"><strong data-start=\"6541\" data-end=\"6608\">Troisi\u00e8mement : Au niveau de la relation propri\u00e9taire-locataire<\/strong><\/p>\n<ul dir=\"ltr\" data-start=\"6610\" data-end=\"8301\">\n<li class=\"\" style=\"text-align: left;\" data-start=\"6610\" data-end=\"6865\">\n<p class=\"\" data-start=\"6612\" data-end=\"6865\">Encadrer les relations locatives de mani\u00e8re \u00e9quitable par une augmentation progressive des loyers chaque ann\u00e9e, selon les taux d\u2019inflation ou un pourcentage du revenu mensuel du locataire, en tenant compte de la capacit\u00e9 \u00e9conomique r\u00e9elle des habitants.<\/p>\n<\/li>\n<li class=\"\" style=\"text-align: left;\" data-start=\"6867\" data-end=\"7190\">\n<p class=\"\" data-start=\"6869\" data-end=\"7190\">Abolir les clauses d\u2019h\u00e9ritage automatique du contrat de location, \u00e0 l\u2019exception du conjoint qui pourrait continuer le bail pour une p\u00e9riode transitoire d\u00e9finie. Le locataire d\u2019origine conserverait ses droits, mais sans transmission automatique aux autres membres de la famille, permettant une r\u00e9gulation du march\u00e9 ancien.<\/p>\n<\/li>\n<li class=\"\" style=\"text-align: left;\" data-start=\"7192\" data-end=\"7427\">\n<p class=\"\" data-start=\"7194\" data-end=\"7427\">Recenser les logements vacants soumis \u00e0 l\u2019ancien syst\u00e8me locatif, et fixer un d\u00e9lai pour r\u00e9tablir une relation libre entre bailleurs et locataires dans ces cas, permettant leur r\u00e9int\u00e9gration dans le march\u00e9 avec des m\u00e9canismes justes.<\/p>\n<\/li>\n<li class=\"\" style=\"text-align: left;\" data-start=\"7429\" data-end=\"7688\">\n<p class=\"\" data-start=\"7431\" data-end=\"7688\">Imposer des restrictions juridiques \u00e0 la lib\u00e9ralisation des loyers dans les logements occup\u00e9s, emp\u00eachant les expulsions, sauf en cas de relogement appropri\u00e9, ou avec un accord volontaire pr\u00e9voyant une transition \u00e9quitable sans atteinte au droit au logement.<\/p>\n<\/li>\n<li class=\"\" style=\"text-align: left;\" data-start=\"7690\" data-end=\"8048\">\n<p class=\"\" data-start=\"7692\" data-end=\"8048\">L\u2019\u00c9tat doit assumer sa responsabilit\u00e9 sociale envers les propri\u00e9taires et locataires affect\u00e9s, en cr\u00e9ant un fonds de soutien des loyers pendant une p\u00e9riode transitoire d\u00e9termin\u00e9e, ou en accordant des exon\u00e9rations fiscales.
