L\u2019intervention l\u00e9gislative dans le march\u00e9 locatif ne r\u00e9pondait pas seulement \u00e0 des crises \u00e9conomiques passag\u00e8res, mais s\u2019est progressivement institutionnalis\u00e9e en tant que composante structurelle de la politique du logement, donnant naissance \u00e0 un r\u00e9gime juridique particulier connu sous le nom de \u00ab syst\u00e8me des anciens loyers \u00bb.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Dans le deuxi\u00e8me article de la s\u00e9rie sur le syst\u00e8me de location ancien en \u00c9gypte, cet article met en lumi\u00e8re les facteurs historiques et les l\u00e9gislations qui ont influenc\u00e9 le syst\u00e8me de location ancien depuis le si\u00e8cle dernier jusqu&rsquo;\u00e0 aujourd&rsquo;hui.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><a href=\"https:\/\/lawskw.com\/section\/%D9%88%D8%B3%D9%8A%D8%B7-%D8%A7%D9%84%D8%B3%D9%86%D9%87%D9%88%D8%B1%D9%8A---%D8%A7%D9%84%D8%AC%D8%B2%D8%A1-6-%D8%A7%D9%84%D8%B3%D8%A7%D8%AF%D8%B3---%D8%A7%D9%84%D9%85%D8%AC%D9%84%D8%AF-2-%D8%A7%D9%84%D8%AB%D8%A7%D9%86%D9%8A\">Le contrat<\/a> de location est, en principe, un contrat consensuel qui permet au locataire de jouir d\u2019un bien immobilier moyennant un loyer d\u00e9termin\u00e9. En \u00c9gypte, le syst\u00e8me dit des anciens loyers s\u2019est d\u00e9velopp\u00e9 en dehors du Code civil, comme un cadre juridique exceptionnel visant \u00e0 prot\u00e9ger les locataires et \u00e0 garantir la stabilit\u00e9 du logement, notamment dans des p\u00e9riodes de transition politique et \u00e9conomique. Parmi ses caract\u00e9ristiques essentielles : la prorogation automatique des contrats au-del\u00e0 de leur terme initial sans renouvellement formel, la transmissibilit\u00e9 du contrat en cas de changement de propri\u00e9taire, et un encadrement strict de l\u2019\u00e9volution des loyers selon l\u2019emplacement et la nature des biens.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">L\u2019expulsion \u00e9tait rigoureusement limit\u00e9e : elle ne pouvait intervenir ni \u00e0 l\u2019expiration du contrat ni lors de la vente du bien, mais seulement dans certains cas d\u00e9finis (d\u00e9molition, besoin personnel du propri\u00e9taire), sous conditions juridiques strictes. Des exceptions proc\u00e9durales ont \u00e9galement \u00e9t\u00e9 introduites, comme le transfert de la comp\u00e9tence aux juridictions sup\u00e9rieures et l\u2019irr\u00e9vocabilit\u00e9 de certaines d\u00e9cisions judiciaires. Bien que ce syst\u00e8me ait offert une protection importante aux locataires, il a soulev\u00e9 des probl\u00e9matiques juridiques et de droits humains, notamment vis-\u00e0-vis des normes internationales garantissant le droit \u00e0 un recours effectif.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><strong>Premi\u00e8res interventions : les guerres mondiales et leurs suites<\/strong><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">L\u2019intervention de l\u2019\u00c9tat dans les relations locatives commence pendant <a href=\"https:\/\/www.youm7.com\/story\/2023\/10\/2\/%D8%B1%D8%AD%D9%84%D8%A9-%D9%82%D9%88%D8%A7%D9%86%D9%8A%D9%86-%D8%A7%D9%84%D8%A5%D9%8A%D8%AC%D8%A7%D8%B1%D8%A7%D8%AA-%D9%85%D9%86%D8%B0-%D8%B9%D8%A7%D9%85-1920-%D9%83%D9%8A%D9%81-%D8%A8%D8%AF%D8%A3%D8%AA-%D9%88%D8%A3%D9%8A%D9%86-%D8%A7%D9%86%D8%AA%D9%87%D8%AA\/6322651\">la Premi\u00e8re Guerre<\/a> mondiale avec la loi n\u00b011 de 1920, qui plafonne l\u2019augmentation des loyers \u00e0 150 % par rapport \u00e0 ao\u00fbt 1914, et interdit les expulsions sans d\u00e9cision judiciaire. La loi n\u00b04 de 1921 \u00e9tend ces mesures \u00e0 tous les biens r\u00e9sidentiels et commerciaux. Pendant la Seconde Guerre mondiale, la loi n\u00b0151 de 1941 g\u00e8le davantage les loyers et prolonge automatiquement les baux afin de prot\u00e9ger les citoyens contre les hausses de prix dues \u00e0 la demande \u00e9trang\u00e8re.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Face \u00e0 l\u2019aggravation de la crise du logement apr\u00e8s la guerre, le gouvernement adopte la <a href=\"https:\/\/lalexu.journals.ekb.eg\/article_294837.html\">loi n\u00b0121 de 1947,<\/a> marquant un tournant majeur : elle institue un contr\u00f4le strict des loyers, limite le droit \u00e0 l\u2019expulsion, et encadre fortement la r\u00e9cup\u00e9ration des biens par les propri\u00e9taires. Cette l\u00e9gislation ouvre la voie \u00e0 une intervention \u00e9tatique plus profonde et durable.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><strong>Sous Nasser : une nationalisation de fait des relations locatives<\/strong><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Sous la pr\u00e9sidence de Gamal Abdel Nasser, et dans le cadre des r\u00e9formes socialistes, l&rsquo;\u00c9tat \u00e9tend radicalement son emprise sur le march\u00e9 locatif. Le loyer devient un droit quasi-permanent, et la propri\u00e9t\u00e9 priv\u00e9e perd son r\u00f4le central dans les rapports d\u2019habitation. Cette politique s\u2019inscrit dans un discours de justice sociale visant \u00e0 freiner la sp\u00e9culation immobili\u00e8re et \u00e0 garantir un acc\u00e8s \u00e9quitable au logement.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Entre 1952 et 1965, au moins cinq <a href=\"https:\/\/www.parlmany.com\/News\/2\/533359\/%D9%84%D9%84%D9%85%D9%84%D8%A7%D9%83-%D9%88%D8%A7%D9%84%D9%85%D8%B3%D8%AA%D8%A3%D8%AC%D8%B1%D9%8A%D9%86-%D9%85%D8%B1%D8%A7%D8%AD%D9%84-%D8%AA%D9%82%D9%86%D9%8A%D9%86-%D9%82%D8%A7%D9%86%D9%88%D9%86-%D8%A7%D9%84%D8%A5%D9%8A%D8%AC%D8%A7%D8%B1-%D9%85%D9%86%D8%B0-%D8%B9%D8%A7%D9%85-1920-16#:~:text=%D8%A3%D9%85%D8%A7%20%D9%81%D8%AA%D8%B1%D8%A9%20%D9%85%D8%A7%20%D8%A8%D8%B9%D8%AF%20%D8%AB%D9%88%D8%B1%D8%A9%201952%20%D9%88%D8%AD%D8%AA%D9%8A%20%D8%A7%D9%84%D8%B3%D8%AA%D9%8A%D9%86%D8%A7%D8%AA%3A\">lois majeures<\/a> sont adopt\u00e9es (notamment les lois n\u00b0199\/1952, 55\/1958, 168\/1961, 46\/1962 et 7\/1965), r\u00e9duisant les loyers de 15 \u00e0 35 % selon la date de construction. Des commissions judiciaires sp\u00e9cialis\u00e9es sont mises en place pour fixer les loyers, sur la base d\u2019un rendement jug\u00e9 \u00ab \u00e9quitable \u00bb pour les propri\u00e9taires \u2013 instaurant ainsi un mod\u00e8le de loyer social, \u00e9loign\u00e9 des logiques du march\u00e9.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Cette approche repose sur l\u2019id\u00e9e que le logement est un droit social n\u00e9cessitant une protection contre les al\u00e9as du march\u00e9. <a href=\"https:\/\/manshurat.org\/node\/31921\">En 1969, la loi n\u00b052<\/a> g\u00e9n\u00e9ralise la prorogation automatique des baux et autorise leur transmission aux membres de la famille jusqu\u2019au troisi\u00e8me degr\u00e9.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><strong>Sous Sadate et Moubarak : une stabilit\u00e9 juridique sous tension<\/strong><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Malgr\u00e9 les politiques de lib\u00e9ralisation \u00e9conomique engag\u00e9es par Anouar el-Sadate, le r\u00e9gime des anciens loyers reste en place. <a href=\"https:\/\/serviceapi.egyptianlaws.com\/ExpanSingleTash\/ViewListMowad?path=1977-9-8-1977-49.pdf\">La loi n\u00b049 de 1977<\/a> abroge les lois pr\u00e9c\u00e9dentes mais conserve l\u2019encadrement des loyers et les restrictions \u00e0 l\u2019expulsion. La loi n\u00b0136 de 1981 introduit de nouveaux \u00e9l\u00e9ments, notamment le paiement d\u2019avance \u00e9quivalent \u00e0 deux ann\u00e9es de loyer pour les logements neufs, et la possibilit\u00e9 d\u2019augmentations annuelles limit\u00e9es pour les baux commerciaux.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">La vraie rupture intervient avec <a href=\"https:\/\/manshurat.org\/node\/596\">la loi n\u00b04 de 1996<\/a>, qui r\u00e9tablit la libert\u00e9 contractuelle pour les nouveaux baux et applique les r\u00e8gles du Code civil. La Cour accorde un d\u00e9lai de cinq ans avant la r\u00e9siliation de ces contrats, au nom du respect de la propri\u00e9t\u00e9 priv\u00e9e et du d\u00e9veloppement urbain.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">En octobre 2023, le pr\u00e9sident <a href=\"https:\/\/www.youtube.com\/watch?v=QEwizZP99Vc&amp;ab_channel=ON\">Abdel Fattah al-Sissi<\/a> appelle \u00e0 une r\u00e9solution d\u00e9finitive du dossier des anciens loyers. Un an plus tard, en novembre 2024, la Cour constitutionnelle supr\u00eame <a href=\"https:\/\/ecss.com.eg\/49404\/#:~:text=%D8%A3%D8%B5%D8%AF%D8%B1%D8%AA%20%D8%A7%D9%84%D9%85%D8%AD%D9%83%D9%85%D8%A9%20%D8%A7%D9%84%D8%AF%D8%B3%D8%AA%D9%88%D8%B1%D9%8A%D8%A9%20%D8%A7%D9%84%D8%B9%D9%84%D9%8A%D8%A7%20%D9%81%D9%8A,%D8%A7%D9%84%D9%81%D8%B5%D9%84%20%D8%A7%D9%84%D8%AA%D8%B4%D8%B1%D9%8A%D8%B9%D9%8A%20%D8%A7%D9%84%D8%AD%D8%A7%D9%84%D9%8A%D8%8C%20%D9%88%D9%82%D8%AF%20%D8%A7%D8%B3%D8%AA%D9%86%D8%AF\">d\u00e9clare<\/a> inconstitutionnels deux autres articles des lois n\u00b049\/1977 et 136\/1981, concernant le gel des loyers.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">La Cour donne au Parlement jusqu\u2019en juin 2025 pour modifier le r\u00e9gime des anciens loyers. Mais ce d\u00e9lai soul\u00e8ve des craintes : absence d\u2019\u00e9tude d\u2019impact, consultations publiques insuffisantes, et exclusion potentielle des principales parties prenantes, propri\u00e9taires comme locataires. \u00c0 d\u00e9faut d\u2019une nouvelle loi, les r\u00e8gles g\u00e9n\u00e9rales du Code civil s\u2019appliqueront automatiquement, ce qui pourrait bouleverser le march\u00e9 locatif.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\"><strong>Conclusion<\/strong><\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Bien qu\u2019exceptionnelles, les lois sur les anciens loyers ont longtemps \u00e9t\u00e9 per\u00e7ues comme des mesures de protection sociale, surtout en p\u00e9riode de crise du logement. Leur \u00e9volution refl\u00e8te les tensions profondes entre justice sociale et droit de propri\u00e9t\u00e9, entre stabilit\u00e9 r\u00e9sidentielle et logique d\u2019investissement immobilier.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Dans un contexte de lib\u00e9ralisation \u00e9conomique croissante, ignorer les dimensions historiques et sociales du contr\u00f4le des loyers risquerait de provoquer une nouvelle crise.
